LEMAITRE, Julieta y RESTREPO, Esteban (2019). Law and Violence in the Colombian Post-Conflict: State-Making in the Wake of the Peace Agreement

Colombia’s 2016 Peace Agreement with the FARC guerrilla extends beyond the end of the war and those measures for the disarmament, demobilization and reincorporation of former guerrillas. A large portion of the agreement is dedicated to the extension of the presence of the Colombian State into those areas of the country formerly under FARC control. The premise behind this extension, shared by Colombian elites as much as former guerrilla leaders, is that if the State remains absent then the areas will be occupied by criminal organizations interested in controlling the FARC cocaine trade, and, more generally, that the vast and sparsely populated territories will further descend into barbarism. This premise resonates with a long arc of persistent aspiration for a national identity that is shaped by the opposition between civilization and barbarism. Especially since the transformations effected by Colombia’s 1991 Constitution, the extension of civilization has been increasingly identified with the expansion of the rule of law and, therefore, with law’s mythical powers to order society and control barbarism. Under this premise, violence is equated to lawlessness and the remedy for violence assimilated to the expansion of the Estado social de derecho, the state form that embodies the rule of law in the Colombian Constitution. The foundational narrative of civilization versus barbarism, reflected by the hopes placed on the rule of law and the recipes for State-building by the 2016 Peace Agreement, continues to obscure the continuities between law and violence, and particularly the fact that the execution of legal institutions in formerly “lawless” territories maintains the violence of the moment of the adoption of legality. Both theoretical and empirical explorations of the present process of expansion of the Colombian State require critical examination of the hopes vested on law. A critical examination of this sort needs to engage with the continuities between law and violence explored in contemporary political philosophy and developed by Jean and John Comaroff’s ethnography. The productivity of this approach is highlighted by the essays in this dossier, which share the impulse to interrupt the foundational narrative of civilization and barbarism that remains in the institutions of Colombias’s present post-conflict endeavor.

ESLAVA, Luis y Lina BUCHELY (2019). ¿Seguridad y desarrollo? Una historia sobre los pequeños crímenes, el pequeño Estado y sus pequeñas leyes

En este artículo discutimos las promesas y los límites del discurso de “Seguridad y Desarrollo”. Usando Cali (Colombia) como nuestro estudio de caso, mostramos cómo las iniciativas asociadas con este discurso terminan produciendo un conjunto de arreglos institucionales y humanos precarios, en vez de ayudar a los Estados a superar la inseguridad, la exclusión y los bajos niveles de desarrollo. En este artículo caracterizamos esta precariedad en términos de “pequeñez”: una caracterización que para nosotros sugiere la limitación de los tipos marginales de soluciones que en última instancia forman el núcleo de la Seguridad y el Desarrollo, así como de la fragilidad que han marcado los arreglos institucionales y humanos que él mismo construye. El resultado final es una permanente liminalidad del Estado y una continuación de la inseguridad.

BARRETO LEMOS, Carolina (2018). Entre direitos, regalias, regras e castigos: sentidos de justiça nas cadeias do Distrito Federal

O objetivo deste trabalho é analisar os sentidos de justiça nas cadeias do Distrito Federal, explorando principalmente sua associação com o acionamento das categorias nativas direitos, regalias, regras e castigos e as articulações entre as práticas locais e a legislação de execução penal. As reflexões apresentadas fazem parte dos resultados de uma pesquisa etnográfica realizada em cadeias do DF entre 2014 e 2016. A análise revelou que os sentidos locais de justiça constituem uma dimensão central do encarceramento e que são recorrentemente articuladas por presos/as como experiências de injustiça que caracterizam formas de desconsideração que negam sua dignidade e identidade. Apontou, além disso, para instâncias de produção e aplicação de normas que traduzem uma concepção de justiça singular – profundamente marcada por um viés autoritário – que caracteriza a cultura punitiva no Brasil.

RODRIGUES, Christopher VILLARUEL, Mario Luis (2018). Disjunções na aplicação da medida de proteção por acolhimento institucional para adolescentes em conflito com a lei

The Estatuto da Criança e do Adolescente [Child and Teenager’s Statute] establishes what are the applica-ble protective measures in situations of children and teenagers’ rights violation; as well teenagers’ juvenile delinquency programs in conflict with the law, report-ing between them, the institutional refuge, in the first case, and the committal, in the second one. The bib-liography about children and teenagers’ institutional-ization in Brazil aims an oscillation between “forlorn infant” and the “juvenile offender”, that materializes, now a days, in cases that committal egression by in-fractional act needs the protection measure of institu-tional refuge and are undergone an “wandering”, un-dergoing successive host institution transfers under many justifications. This reflection shows us how, in-stead of important legal changes in children and teen-agers rights, the delinquency is, for plenty teenagers, an exclusion element of protection measures, an anachronistic situation treating of rights, doing ECA as an extension of criminal code. In this sphere, this project aims to discuss the political conditions these youngers are going straight, when the wandering by many refuges institutes eventually excludes them to the Rights Assurance System, becoming next to homo sacer by Giorgio Agamben, suspending the legal or-der, in this kind of case, to make work a system that seems to allow to teenagers treated as delinquents, life’s defenselessness. For that, we are going to pres-ent ethnographic data, provided by observation during teenagers’ transference cases in institutional refuges discusses – that were previously checked by socio-educative measure. The notes presented here are multidimensional, a work realized in loco, con-sidering specially, theorical and methodologic dia-logues between psychoanalysis, laws anthropology and punishment sociology.

AGUILAR, Ixchell (2012). Una mirada sociológica a adolescentes infractores en internamiento

Informe de Servicio Social realizado en la Comunidad Especializada para Adolescentes “Dr. Alfonso Quiroz Cuarón”

El presente reporte lo he organizado de la siguiente manera. Parto de lo general a lo particular para entender la importancia social que tiene CEA-QC. Para ello, primero es necesario saber sobre el fenómeno que la sostiene, en este caso, la delincuencia de menores de edad, es por ello que en el capítulo 1 se define dicha problemática, así como también, se ilustran por medio de estadísticas la situación en la que se encuentra el Distrito Federal.
